1. About this document
This Privacy Policy & Terms of Service (the “Agreement”) is entered into between Nirvana Treats Bangkok Massage (“we”, “us”, “our”, or the “Spa”), operating at Sukhumvit 85, Bang Chak, Phra Khanong, Bangkok 10260 and 1122 Sukhumvit Road, Phra Khanong, Khlong Toei, Bangkok 10110, and you (the “Client”, “Guest”, “Visitor”, or “User”).
By visiting our premises, browsing this website, contacting us through any channel (phone, WhatsApp, LINE, WeChat, KakaoTalk, Facebook, Instagram, TikTok, email, or in person), booking a treatment, or accepting a treatment, you acknowledge that you have read, understood, and agreed to be bound by every clause of this Agreement. If you do not agree, you must not use our services or this website.
2. Personal data we collect
In accordance with the Thailand Personal Data Protection Act B.E. 2562 (2019) (“PDPA”), we collect and process the following categories of personal data only to the extent necessary to provide our services, operate our business, and comply with applicable law:
- Identity & contact data: name, nationality, phone number, email, messaging IDs (LINE, WhatsApp, WeChat, KakaoTalk), social handles, hotel/home address for at-home service, room number.
- Booking & service data: services selected, therapist preference, date/time, duration, price, payment method, transaction reference, loyalty status, package balance.
- Health & sensitive data (with your explicit consent only): pregnancy, allergies, injuries, surgeries, chronic conditions, medications and other information you voluntarily disclose so we can deliver a safe treatment.
- Technical data: IP address, device, browser, language, referrer, UTM parameters, click identifiers (gclid, fbclid), cookies, session recordings, page views, scroll depth, and event interactions captured by Google Analytics 4, Google Tag Manager, Google AdSense and Meta (Facebook) Pixel.
- Imagery: photographs and video recordings (including in-store CCTV) of the premises, treatments, events, and team members.
- Communications: the content of messages, calls, reviews, and complaints exchanged with us through any channel.
3. How we use your data & legal basis (PDPA)
We process personal data on one or more of the following lawful bases under the PDPA: contract performance (to fulfil your booking), legitimate interest (to operate, secure, market, and improve our services), legal obligation (tax, accounting, public-health, safety, anti-fraud), vital interest (medical emergency), and explicit consent (sensitive health data, marketing communications, photo/video use).
Specifically, we use your data to:
- Confirm, modify, cancel, deliver, document, and follow up on treatments and packages.
- Communicate with you about your booking, hours, promotions, gift cards, and membership.
- Process payments, issue receipts, and meet bookkeeping and tax obligations.
- Operate, secure, debug, optimise, personalise, and translate this website and our menus.
- Run analytics, attribution, and remarketing campaigns through Google, Meta, and similar platforms.
- Train staff, audit service quality, and resolve disputes.
- Comply with court orders, regulator requests, or other legal obligations.
4. Photo, video & testimonial rights
By entering our premises or accepting an at-home treatment, you acknowledge that the premises and treatment areas (excluding private treatment rooms) may be monitored by CCTV for safety, security, dispute resolution, and crime-prevention purposes. CCTV footage is retained for up to 90 days, or longer if required for an active investigation.
Testimonials and reviews are opt-in. We will only publish a written or recorded testimonial, review, photograph, or video that you have given us with clear, informed consent — for example, a public Google or Facebook review, a message you sent us specifically as feedback for sharing, or a release form you have signed. Where you do consent, you grant us a non-exclusive, royalty-free licence to display that content on our website, social channels, advertising, and printed materials, credited the way you choose (full name, first name only, initials, or anonymous).
You can withdraw consent at any time. Email hello@nirvanatreatsbangkok.com with the subject line “Remove my testimonial” and we will take the content down from channels we control within 30 days. We cannot remove content from third-party platforms (Google, Facebook, Tripadvisor, etc.) on your behalf — you control those directly through the platform.
For our therapists and team members: any promotional photograph or video featuring you that is created during your engagement with us is licensed for use during your engagement and for a reasonable period thereafter for archival, historical, and existing-campaign purposes. After your engagement ends you may request removal of identifiable photographs from our website and active advertising at any time, and we will action the request within 30 days.
If you do not wish to be photographed or filmed during a session, please tell our staff before the session begins — we will respect every such request without question.
5. Cookies, analytics & advertising
This website uses first-party and third-party cookies, pixels, local storage, and similar technologies to operate the site, remember your language, measure traffic, and serve relevant advertising. Third-party services include Google Analytics 4, Google Tag Manager, Google AdSense, Meta (Facebook) Pixel, Google Maps, and font and asset CDNs. Each provider acts as an independent or joint controller and is governed by its own privacy policy.
By continuing to use the website after the cookie banner is shown, or by clicking “Accept”, you consent to the placement of these technologies. You may withdraw consent at any time by clearing cookies in your browser; doing so may impair functionality.
6. Data sharing, transfers & retention
We do not sell personal data. We may share data with: payment processors, accountants, legal advisors, IT and hosting providers, marketing platforms, courier and ride-hail services (for at-home visits), insurance providers, and law-enforcement or regulatory authorities where required.
Some recipients (e.g. Google, Meta, hosting providers) may process data outside Thailand. We rely on the recipient’s adequacy determination, standard contractual clauses, or your explicit consent as the basis for the transfer.
We retain personal data for as long as is necessary to fulfil the purposes set out above, or for a longer period where required by tax, accounting, or other applicable law (typically up to 10 years for financial records and 5 years for general booking records). Anonymised or aggregated data may be retained indefinitely.
7. Your rights as a data subject
Subject to the conditions and exceptions of the PDPA, you have the right to: access your data, rectify inaccuracies, request erasure, restrict processing, object to processing, request portability, withdraw consent, and lodge a complaint with the Personal Data Protection Committee of Thailand. To exercise any right, contact us in writing at +66 61 660 2215 or via LINE @nirvanatreatsbkk. We may need to verify your identity before responding and will respond within 30 days. We may refuse or charge a reasonable fee for manifestly unfounded or excessive requests.
8. Booking, payment, cancellation & no-show
- All bookings are subject to therapist availability and confirmation by us.
- Quoted prices are in Thai Baht (THB) and may be revised without prior notice. The price applicable to your booking is the price confirmed at the time of booking.
- For at-home, in-hotel, and group bookings, we may require a deposit of up to 100% of the service price in advance.
- Cancellation: free of charge if made at least 4 hours before the start time. Cancellations within 4 hours, or no-shows, may be charged up to 100% of the service price; for at-home and group bookings, up to 100% of the service price plus reasonable transport costs.
- Late arrival: we will do our best to deliver the full session, but if it is not possible, the session will end at the originally scheduled time and the full price applies.
- No refunds are given for treatments that have already been delivered, partially delivered, or left unfinished due to the Client’s conduct, intoxication, health condition, or change of mind.
- Gift cards, prepaid packages, and promotional credits are non-refundable, non-transferable, and have a validity period as stated at purchase. Unused balances expire and are forfeited at the end of that period.
9. Health disclosure & assumption of risk
Massage and spa treatments are not a substitute for medical advice, diagnosis, or treatment. You agree to disclose, accurately and in advance, any condition that may be affected by treatment, including but not limited to: pregnancy, recent surgery, fractures, blood clots, infectious or contagious skin conditions, cardiovascular disease, diabetes, epilepsy, cancer, allergies, and current medications.
By accepting treatment, you represent that the information you have provided is true and complete and you voluntarily assume all risks arising from the treatment, including but not limited to soreness, bruising, allergic reactions, dizziness, temporary discomfort, or aggravation of pre-existing conditions. We reserve the right to refuse or modify any treatment for safety reasons.
10. Code of conduct & zero-tolerance policy
Nirvana Treats Bangkok Massage is a strictly professional, non-sexual wellness establishment. We have a zero-tolerance policy toward:
- Any sexual advance, request, comment, gesture, or exposure directed at our staff or other guests.
- Verbal abuse, harassment, threats, intoxication, drug use, or violence on our premises or during an at-home visit.
- Discrimination of any kind.
- Recording or photographing therapists, other guests, or treatment areas without express permission.
Any breach will result in immediate termination of the session with no refund, permanent ban from all branches and channels, full charge of the booked service plus a compensation fee equivalent to three (3) times the service price for the inconvenience caused, and where appropriate, a report to the Royal Thai Police.
11. Non-solicitation of staff
You agree not to solicit, hire, contract, refer, employ, or attempt to engage any therapist, masseur, masseuse, or other team member of Nirvana Treats Bangkok Massage, directly or indirectly, for any massage, spa, wellness, or related service, whether paid or unpaid, during their engagement with us and for a period of twenty-four (24) months following the end of that engagement. Any breach entitles us to liquidated damages of THB 300,000 per incident, plus reasonable legal costs, without prejudice to any further remedy available at law.
12. Personal property & valuables
Lockers and storage areas are provided as a courtesy. You are solely responsible for your belongings. Nirvana Treats Bangkok Massage, its owners, employees, and agents are not liable for any loss, theft, or damage to cash, jewellery, electronics, clothing, or other personal items, whether on our premises or at the location of an at-home visit. Please do not bring valuables you are not prepared to lose.
13. Limitation of liability & indemnity
To the maximum extent permitted by law, the aggregate liability of Nirvana Treats Bangkok Massage and its owners, directors, employees, contractors, and agents for any claim arising out of or related to a treatment, this website, or this Agreement, whether in contract, tort, statute, or otherwise, is limited to the amount actually paid by the Client for the specific service that gave rise to the claim. Under no circumstances shall we be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of opportunity, loss of data, or emotional distress.
You agree to indemnify, defend, and hold harmless Nirvana Treats Bangkok Massage and its team from and against any claim, damage, liability, cost, or expense (including reasonable legal fees) arising from (a) your breach of this Agreement, (b) any false or misleading information you provide, (c) damage to our property caused by you or your guests, or (d) injury to any person caused by your conduct.
14. Intellectual property
The name “Nirvana Treats Bangkok Massage”, our logo, our menu and pricing structure, our therapy protocols, our website design, code, photographs, videos, copy, translations, and all related materials are the exclusive intellectual property of Nirvana Treats Bangkok Massage and are protected by Thai and international copyright, trademark, and trade-secret law. No part may be copied, scraped, mirrored, reposted, used to train any artificial-intelligence model, or otherwise exploited without our prior written consent. Limited personal viewing in a standard browser is permitted.
15. Reviews, complaints & defamation
We welcome honest, fair reviews. If you have a concern about a treatment or interaction, we ask that you contact us first at +66 61 660 2215 or via LINE @nirvanatreatsbkk so that we have a reasonable opportunity to investigate and resolve the matter. Any review, post, or statement that is materially false, misleading, malicious, or defamatory will be addressed under the Civil and Commercial Code of Thailand and the Computer Crime Act B.E. 2550, including but not limited to takedown demands and a claim for damages.
16. Right to refuse service
We reserve the absolute right to refuse, suspend, or terminate service to any person at any time, with or without reason, where in our reasonable judgement doing so is necessary to protect the safety, dignity, or wellbeing of our team, our guests, or our business.
17. Force majeure
We are not liable for any failure or delay in performing this Agreement that is caused by circumstances beyond our reasonable control, including but not limited to natural disaster, pandemic, government order, civil disturbance, strike, utility failure, or telecommunications outage. In such cases we will, where possible, reschedule the affected booking; otherwise, prepaid amounts for undelivered services will be refunded or credited at our discretion.
18. Governing law, venue & severability
This Agreement is governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict-of-laws principles. The Courts of Bangkok, Thailand shall have exclusive jurisdiction over any dispute arising out of or relating to this Agreement. The Thai-language version shall prevail in the event of any inconsistency between language versions. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Changes to this Agreement
We may update this Agreement at any time. The current version is always published at this URL with its “Last updated” date. Continued use of our services or website after a change is published constitutes acceptance of the updated Agreement.
